What is IMBRA?
IMBRA is the "International Marriage Broker Regulation Act of 2005 (IMBRA)." It was signed into USA law in January 2006 and is aimed at protecting foreign nationals who enter into marriages with U.S. citizens through international marriage brokers. The purpose of this law is to protect spouses in any abusive relationship, not only women.
Who does it affect?
Citizens of USA only and prospective spouses (fiancee’s) from foreign countries.
I am not a citizen of USA, does the law affect me?
No, it doesn't.
Requirements under the new law
Prospective foreign spouses will be provided with information pertaining to any criminal background of the prospective U.S. spouse. The foreign spouse will also receive information regarding legal rights with regard to domestic violence. Marriage brokers are required to conduct background searches on their clients.
How is this information gathered?
There are 2 simple forms that must be completed by the U.S. citizen and supplied to the marriage broker:
- The Client Background Information Form
- The Foreign National Client Consent and Release Form

These forms must be made available to the prospective fiancée before she meets the U.S. citizen in person. The marriage broker must perform a check of the U.S. citizen on the USA Sex Offender List website.
The marriage broker must supply the prospective fiancée a document explaining her rights under USA law. This form must be translated into her native language. Finally, the prospective spouse must sign a form consenting to the release of her contact details to the U.S. citizen.
When must these requirements be met?
Before the U.S. citizens and the prospective fiancée meet face to face. We will ask you to complete these forms before you travel to meet your special lady.
Is this information kept confidential?
Yes. It is retained by the marriage broker and must be kept confidential.
When are these forms supplied to the USA Immigration Service?
When the U. S. citizen applies for a fiancée visa for his special lady to enter the USA, U.S. immigration will ask which marriage broker you used to meet your fiancée. The marriage broker must supply the forms to the U. S. Immigration service.
What happens if I apply for a fiancée visa to enter the USA and I have not complied with these laws? The fiancée visa for your prospective spouse will be declined.
Are there any circumstances where we will allow a U.S. citizen to meet a lady without complying with these laws? No, there are none.
Are we IMBRA certified?
There is no certification for marriage brokers for IMBRA compliance. It is a requirement by U.S. Law. Failure to comply with this requirement will result in the fiancée being denied access into the USA.
